Our Confidence In Saraki Stands, Says PDP Senators

Some senators on Friday restated their confidence in the President of
the Senate, Bukola Saraki, in spite of the disagreement over Rotimi
Amaechi's confirmation as minister on Thursday.

The senators, who are members of Peoples Democratic Party (PDP), said
that they would also continue to support Saraki as he faced his trial
at the Code of Conduct Tribunal.
One of them, Gershom Bassey, said that there was no rift between the
senators of the PDP and their All Progressives Congress (APC)
counterparts in the red chamber, adding that the PDP senators still
had confident in Saraki's leadership.

Bassey said that the senators may disagree on issues, but that such
disagreements were healthy for legislation.

"We have had two votes of confidence on him and they stand. He has the
confidence of the senate and there is absolutely no problem.

"In spite of the disagreement between the APC and PDP senators,
nothing has changed. In democracy, people must have different points
of view and we must express those points of view.

"The senate is a vibrant senate that has a lot of vibrant debates; the
Senate is not a football team that we all have to play in the same
direction,'' he said.

According to him, in the senate, we can play in different directions
and still score the goal; I think the more debate there is in the
senate, the more vibrant it is.

"We must continue to discus different points of view; it is important
that we have different points of view, but that does not mean we are
enemies,'' Bassey said.

He revealed that the major disagreement was not the petition against
Amaechi, but the move by APC senators to flout the rules of the senate
and confirm the nominee without considering the report on him.

He said that PDP senators did not see any reason for the rush to
confirm Amaechi, adding that PDP would never be part of any move to
disobey the rules of the senate in favour of anyone.

On his part, Sen. George Sekibo (PDP Rivers East) said that PDP
members at the upper chamber walked out to protest the refusal of the
senate to discuss a committee's report on Amaechi, insisting that they
would not go back on the decision.
Sekibo, who submitted the petition against Amaechi to the senate
shortly after the former governor was nominated by President Muhammadu
Buhari for ministerial appointment, said that PDP senators had made
their position known.

According to him, it is now left for Nigerians to know what to do.
On Saraki's assets declaration trial, he maintained that PDP senators
were solidly behind him.

"The Code of Conduct case is against an individual and not APC. We
gave him our support in the spirit of esprit de corps.

"As far as senators are concerned, what happened yesterday has passed;
we are not working for political parties, but for the entire nation.

"When the time comes to express the wish of your people, you do that
and that is what we did yesterday.

"We didn't get it, so we let it go so that the country can move
forward; we cannot hold the country to ransom," he said.

Saraki Fights Back, Heads To Supreme Court

Nigeria's Senate President, Bukola Saraki has stated that he will head
to the Supreme Court in search of justice after a Court of Appeal
ruled against him.

Saraki's position was conveyed by his lead lawyer, Mohammed Mogaji. He
revealed that Senator Saraki would file a further appeal at the
Supreme Court.

Saraki wanted the appellate court stop his trial at the Code of
Conduct Tribunal, where he has been charged on 13-counts with false
asset declaration.

Delivering judgment today, Justice Moore Agumanen, who read a majority
verdict of the Court of Appeal morning upheld the trial of Senate
President, Bukola Saraki at the Code of Conduct Tribunal.

Reading the verdict of two of the three man panel, he said the
tribunal, which docked the Senate President on 22 September and 21
October was properly constituted, thus trashing one of the grounds of
the objections to the trial by Senate President and his lawyers.

The dissenting third judge, Justice Joseph Ekanem however ruled that
Saraki's appeal has merit.

On the contrary, the majority judges, including Justice Mohammed
Mustapha, in their verdict said the tribunal led by Danladi Umar could
sit with the chairman and one other member.

Agumanen said they relied on section 28 of the Interpretation Act to
reach the decision.

He said the Code of Conduct Tribunal and Code of Conduct Bureau Act
and the constitution did not talk about a quorum.

In a further blow to the Senate President, the majority judges said
the CCT has criminal jurisdiction, though limited.

The judges also ruled that the Code of Conduct Tribunal has powers to
issue a bench warrant.

The court further ruled that the solicitor-general can institute
proceedings in the absence of the attorney-general since the office of
the AGF is statutory and cannot die whether the AGF is in court or
not.

Emir Sanusi After Graveyard Of Past Emirs, Says Bayero’s Lawyer

Counsel to Alhaji Salim Bayero, the Kano prince who took Emir
Muhammadu Sanusi to court has explained that the Emir of Kano was
going to demolish graveyards of past emirs.

Mr Sanusi Sadiq, told newsmen that what the emir and the council were
seeking to destroy was the graveyard where no fewer than 13 former
Kano emirs were buried.

He explained that the plan to demolish the structures in the palace
was capable of "killing the ancient tradition which Kano emirate
council was known for."

Meanwhile A High Court in Kano on Friday restrained the Emir of Kano,

A High Court in Kano on Friday restrained the Emir of Kano, Alhaji
Muhammadu Sanusi II, from demolishing or tempering with any structure
in the emir's palace.

NAN reports that one Alhaji Salim Bayero had filed the suit, seeking
order to stop the emir, the Emirate Council, Attorney General and
Commissioner for Justice, from destroying some structures in the
palace.

He also prayed the court to restrain the defendants from evicting
occupiers of the structures pending the determination of a substantive
suit on the matter.

The Judge, Justice A.T. Badamasi, in his ruling also restrained the

Mourinho’s Future At Stamford Bridge On The Line?

Facing a crunch match against Liverpool on Saturday, embattled Chelsea
manager Jose Mourinho must confront an adversary who condemned him to
one of the most painful defeats of his career.

Jurgen Klopp, Liverpool's new manager, was in charge of the Borussia
Dortmund side who ousted Real Madrid in the 2012-13 Champions League
semi-finals, dashing Mourinho's dream of bringing the European Cup
back to the Bernabeu in what he knew would be his final season at the
club.

The pair resume hostilities with Mourinho reported to be facing the
sack if results do not improve after the defending champions slumped
to 15th place in the Premier League and were knocked out of the League
Cup by Stoke City, but he has played down the significance of Klopp's
arrival.

"They were a good team, they are a good team," Mourinho told his
pre-game press conference.

"They had good players, they have good players. They had a very good
manager, they have a new very good manager.

"Everything is the same. They have changed some details obviously in
their tactical approach, but this is the nature of the game,
especially when you are thinking and speaking about two top managers."

Mourinho is expected to be in the dug-out despite having been hit with
a Football Association misconduct charge after being sent to the
stands during last weekend's 2-1 loss at West Ham United.

But the bad news continues to pile up for the 52-year-old, with former
team doctor Eva Carneiro reported to have begun legal proceedings
against Chelsea after being sidelined by Mourinho earlier in the
season.

Reports differ as to the likely consequences of another defeat for
Mourinho, but there is general consensus that his future at Stamford
Bridge is on the line.

The dismissal of Klopp's predecessor Brendan Rodgers was a stark
reminder of the cost of failure in the English top flight and while
the German drew his first three games, his side travel to London on
the back of a 1-0 League Cup win over Bournemouth.

With his back to the wall, Mourinho needs his senior players to stand
up and be counted, but he may be without striker Diego Costa, who
faces a late fitness test after going off against Stoke with a badly
bruised rib.

Pedro Rodriguez will also undergo a fitness test, while goalkeeper
Thibaut Courtois and Branislav Ivanovic remain out, but Nemanja Matic
is available again after a one-game ban.

Klopp has also been inconvenienced by injury, with Kolo Toure, forced
off against Bournemouth, the latest casualty, while Daniel Sturridge
is taking time to recover from a knock sustained in training.

But James Milner is back from suspension and Christian Benteke is in
contention to lead the line after missing the Bournemouth game with a
knee ligament strain.

Liverpool have not beaten Chelsea in eight matches and have not won at
Stamford Bridge since November 2011, when they won twice there in the
space of 10 days in the league and League Cup.

But Klopp got the better of Mourinho when their paths crossed in
2012-13, with Dortmund taking four points from Madrid in the Champions
League group phase before eliminating them in the last four after a
stirring 4-1 first-leg win in which Robert Lewandowski scored all four
goals.

While a similar outcome on Saturday could have grave repercussions for
Mourinho, Klopp remains a fan.

"From my side, I am full of respect for his work," Klopp said.

"I think if you are not a journalist or a referee he can be a nice
guy, and I am not one of these so we have a good talk.

"He is emotional, I am emotional, but we are full of enough respect
after the whistle that normal life starts again and you can talk
normally about things that happen and that is what we did."

All Five Deputy Comptroller-Generals Of Nigeria Customs Resign In Protest

All five Deputy Comptroller General of the Nigeria Customs Service
have tendered their resignation in an apparent protest today, SKYTREND
NEWS reports.



In a one-page letter jointly signed by the five of them exclusively
obtained by SKYTREND NEWS, the senior officers said they were all
unanimously and voluntarily resigning from the service of the Nigeria
Customs Service having risen to the position of Deputy
Comptroller-General. ( See attached Letters)

SKYTREND NEWS gathered that the officers were sheduled to proceed on
annual leave but they opted to uninanimously resign.



There are a total of six Deputy Comptroller-Generals in Nigeria but
our source, who asked not to be named because he was not privileged to
speak on such matters, said the sixth one had earlier retired before
the resignation of the former Chief Comptroller General of Customs.

According to our source, before now, the five Deputy
Comptroller-Generals were briefly posted to Zonal Offices to work with
the Assistant Comptroller-Generals. After they came back, they were
given letters to proceed on a schedule of annual leave. (See Attached

Outrage In Ibadan As Principal, Teacher Flog Student To Death

Students of IMG Secondary School, Oke Ado, Ibadan, on Wednesday,
expressed outrage after their colleague was allegedly flogged to death
by a teacher.



The yet-to-be identified student reportedly slumped and died following
severe punishment from a teacher for arriving late to school.

Some properties of the school were destroyed by the students before
policemen arrived at the scene.
Chairs and tables, cabinets were destroyed by the protesting students,
even as they scattered documents.

Windows and doors of the staff room were also vandalized.

As the protest escalated, teachers and administrative workers of the
school took to their heels for fear of being attacked.

An eye witness told Nigerian Tribune that trouble started when the
student arrived school after classes had commenced for the day.
"He told the teacher he came late due to illness.

"At that point, the principal, who was passing by asked the teacher
the cause of the discussion.

"The principal ordered the teacher to flog the student for coming late
and he slumped in the process.

"They tried to resuscitate him but it was too late", he disclosed.

Police Public Relations Officer (PPRO), Oyo State Police Command,
Adekunle Ajisebutu, who confirmed the incident said investigation into
the matter had commenced.

Why I Sold My Daughter — 20-Year-Old Mother

MARIA Ekanem, a 20-year-old school drop out from Odukpani Local
Government Area of Cross River State, said yesterday in Calabar that
poverty and lack of where to stay after she gave birth made her sell
her two weeks old baby girl for N20,000.

Maria, who was arrested by the police along five other accomplices,
said her boyfriend who got her pregnant, asked her to abort the baby
but said a doctor helped her with free antenatal care and food until
she gave birth.

This, she added, prompted her to agree to sell the baby when
arrangements were made to sell.

Paraded along with Maria were a 55-year-old medical doctor, Okokon
Offiong Okoho, the proprietor of Evangel Clinic,of 2, Atu Street; a
70-year-old matron of Sadatoe Maternity located at Umoh Street and a
nurse at the maternity who allegedly made the plans to sell the girl
to an Abuja-based lady who is now on the run.

However, plans to sell the two weeks old girl was leaked to the police
by a Senior Secondary Two girl of NYSC Demonstration Secondary School,
Calabar , Maria Elemi, whose parents Maria was living with after she
delivered the baby.

"When I came back from school on Monday, Maria told me she wanted to
take the baby to the parents of the boy who impregnated her since she
can no longer cope with taking care of the baby," she said.

Maria said when they got to Fuller by Inyang Street in Calabar South,
they met Mrs Elemi and her daughter in an SUV car, adding that Maria
gave the girl to the matron who handed her over to the buyer.

She said: "The woman gave Maria N20,000 and asked her to pay the
nurse at the Evangel Clinic and use the rest for herself."

The girl said she became suspicious when the driver of the SUV told
the woman with the baby that her husband said she should take her to
the airport to catch a flight to Abuja.

"I started wondering why they should take the girl to the airport when
the boyfriend to Maria and her parents live here in Calabar," Maria
stated.

Cross River Police Public Relations Officer, ASP John Eluu, who
paraded Maria along with the doctor and Matron, said when information
got to the police at the Federal Housing Police Station, detectives
swung into action and arrested the suspects.

Eluu said investigations were continuing to apprehend the buyer of the
girl who is now on the run.

Senate Confirms Yakubu As INEC Chairman, 5 Others As Commissioners

THE Senate yesterday confirmed the nomination of Professor Mahmood
Yakubu, as the chairman of the Independent National Electoral
Commission, INEC as well as five others as federal commissioners to
represent the five out of the six geopolitical zones of the country.

Those confirmed as federal commissioners of INEC were Alhaji Baba
Shettima Arfo, Dr. Anthonia Taiye Okoosi Simbine, Mrs Amina Zakari,
Dr. mohammed Mustapha Lecky and Mr Soyebi Adedeji Solomon.

It will be recalled that Senate President Bukola Saraki had on
Thursday last week read a letter from President Buhari intimating the
Senate of the name of the new INEC Chairman, Prof Mahmud Yakubu and
five other National Commissioners and for subsequent confirmation.

In the letter, President Buhari also sought for the confirmation of
Amina Bala Zakari who was acting INEC chair as Representative of the
Northwest, Dr. O Taiye Okoosi (Kogi), North-Central, Alhaji Baba
Shettima Arfo (Borno), North-East, Dr. Mohammed Mustapha Lecky (Edo),
South-South and Mr. Soyebi Adedeji Solomon(Ogun) South-West.

Answering questions from the Senators, Professor Yakubu who noted that
he was coming in to consolidate on the achievements of his
predecessor, Professor Attahiru Jega and not for experimentation, said
that he would send to the National Assembly a bill that would amend
the Electoral Act where candidates of political parties would emerge a
year to the elections.

He said, "Prof. Jega has done a marvellous job in reforming the
electoral system of this country. I'm not coming in for
experimentation. I'm coming for consolidation."

The confirmed INEC chairman who boasted that it was too late for
anyone to intimidate him, however vowed that he will not in any way
compromise his position, adding that the issue of E-voting and that of
diaspora were desirable and inevitable, but however warned that if the
E- Voting process must be adopted, Nigeria must trend with caution.

Professor Yakubu said, "I can't be intimidated. In the services of
this country, I can't be intimidated. It is too late. I have the
character to do the right thing.

Appropriate amendment
"The success of any election depends on the ability of the Commission
to organise, arrange elections properly and in advance.
But in this country, we have this culture of last minute rush. And as
a result of this, so many things that are supposed to be done much
early are not done. If six months is the time limit under the law at
present, definitely we will look at the possibility of coming back to
the National Assembly for an of the Electoral Act to enable us have
longer period of time that will allow longer period of preparation."

On E-voting, he said, "It is desirable and inevitable. If you look at
the trajectory from the last 10 years, the voters register comes in an
electronic form. Initially, it was just a register, then photographs
were added.
And in the last election, both photographs and biometric were added.

"So, it is inevitable that one day, we will go into electronic voting.
But the experiences of other nations show that we have to thread
cautiously. It's technology, maybe untried, untested, we get bugged
down. Is it pure electronic voting or electronic voting paper trail
like they do in Venezuela?

"We are still grappling with the problem of infrastructure either for
simple ICT use in our institutions or in our places of work and homes.
So, it's desirable, inevitable, but we need to think through the
implications of what we do.
Otherwise, we may rush into it and just get bugged down.

"There must be no room for experimentation. As far as I'm concerned
something has happened in this country in 2015. And we need to
consolidate on that rather than to begin new experimentation with
longer span of testing the validity of the process.

"Fortunately for us at governorship level, we have staggered election
by default. Very soon, it will be Kogi and Bayelsa. Thereafter, we
will have Ondo, Ekiti, Osun, Edo and Anambra.


"There must be a guiding principle. The workability of the technology
and adequate consultation with stakeholders. The all-tested card
reader and the challenges. The problem of technology is that it always
comes up with challenges."

On Diaspora voting, he said,"That is inevitable. As a student of
history, I know that there was a time in the history of this country
in the First Republic when political parties had branches overseas.
And we have a large number of Nigerians overseas, one estimate put it
at 15million. They remit $20billion annually in returns to the
country.

On Direct and indirect primaries, Professor Yakubu said, "I will like
to see a Commission which consults widely rather than a Commission
which sits in judgement. There are mechanisms for consultation with
the parties through quarterly meetings and Inter Party Advisory
Council (IPAC).

"So, instead of making a commitment on direct or indirect primaries,
we will throw that up to consultations with the political parties. At
the end of which we will then come up with what best method we should
adopt.

"I have a problem with international best practice because we can't
transplant the experiences of other jurisdictions, we can only
borrow."

While responding to questions on the PVC's, the INEC Chairman who
noted that the Commission will focus on the mandate at hand, said

"About 70 million Nigerians registered for the 2015 elections, 56.3
million pvc distributed,500 thousand pvc unprinted at the time of the
elections,12.3million PVCs not distributed.

"Instead of finding fault on why they collected pvc in borno and they
did not collect elsewhere, I will rather focus that by this time next
year all the 12.3million pvc's and 500million PVCs are distributed
subsequently."

Ahead
of 2019 Presidential election, the new INEC Chairman promised that
there will be no issues with regard to PVC collection as it would
ensure that all eligible voters get their PVCs except those not of
age, adding that although people have the right to take the PVCS and
not vote.

Imo Governorship Poll: Supreme Court Upholds Okorocha’s Election

The Supreme Court, yesterday, affirmed Governor Rochas Okorocha as
the winner of the April 11 governorship election in Imo State.

The apex court, in a unanimous judgment by a seven-man panel of
Justices, dismissed the appeal that was lodged before it by former
Deputy Speaker of the House of Representatives and governorship
candidate of the Peoples Democratic Party, PDP, in the state, Mr.
Emeka Ihedioha.

The Supreme Court declined to set-aside two concurrent verdicts of the
Imo State Governorship Election Petition Tribunal and the Court of
Appeal which earlier declared Okorocha as winner of the gubernatorial
poll.

Ihedioha had in a petition he filed before the tribunal on May 19,
sought the nullification of Okorocha's election.

He had among other things, alleged that the election was fraught with
irregularities, insisting that officials of the Independent National
Electoral Commission, INEC, rigged the poll in favour of the All
Progressives Congress, APC.

In the petition marked EPT/IM/GOV/3/2015, which had Okorocha, APC and
36 others as respondents, Ihedioha, told the tribunal that the
election was marred by violence, harassment and intimidation of
voters.

Besides, it was his contention that the election was conducted in
substantial non-compliance to the provision of the Electoral Act.
He maintained that the election was in violation of Paragraph 28 of
INEC's guidelines for the 2015 election.

However, the tribunal, in a judgment it delivered on July 22,
dismissed the petition at the preliminary stage.

The tribunal led by Justice David Wyom held that the petition was
incompetent and lacked merit.

The panel upheld argument by Okorocha's lawyer, Mr. Niyi Akintola,
SAN, that the petition should be deemed as abandoned considering that
Ihedioha, failed to within seven days, pay mandatory N100 required to
kickstart pre-hearing session on his petition as stipulated in Section
18(1) of the Electoral Act, as amended.

The tribunal noted that the petitioner applied on June 23, but failed
to pay for the pre-hearing notice until June 3, despite the fact that
his application was within time.

According to the tribunal, "Based on the strength of the Supreme Court
authority on this issue, the validity of the process starts from when
the pre-hearing notice payment was made and not when it was applied,
this in turn means the petitioner paid out of time but applied within
time".

Meantime, dissatisfied with the decision of the tribunal, Ihedioha
took the matter before the Owerri Division of the Court of Appeal.

In a judgment it delivered on September 3, the appellate court panel
led by Justice Jimmy Bada affirmed the decision of the tribunal,
adding that Ihedioha's notice of appeal was fundamentally defective.

Not happy with the verdict, Ihedioha filed appeal before the Supreme
Court wherein he sought for an order setting aside the concurrent
decisions of the two lower courts.

In the lead judgment that was read yesterday by Justice John Inyang
Okoro, the apex court, said the lone issue to be determined in the
matter was "Whether there was service on the 2nd-36threspondents; if
not, what is the effect".

The apex court relied on Section 318 of the Constitution which deals
on "Interpretation, Citation and Commencement" of hearing, to
discountenance the appellant's argument that the registrar of the
tribunal had announced to parties that notices of appeal had been duly
served on the respondents.

According to Justice Okoro, the word "decision" under Section 318 of
the CFRN "means, in relation to a court, any determination of that
court and includes judgement decree, order, conviction, sentence or
recommendation".

"In view of the foregoing, I do not think the registrar's statement
gave any credence to service of notice of appeal. It is trite that
notice of appeal is a condition precedent, and there is nothing on
record to show that the appellant duly effected service on the
respondents.

This issue does not avail the appellant and I resolve it against the
appellant." he added.

More so, the apex court held that the statement of the registrar that
there was service on all respondents did not emanate from the chairman
of the tribunal nor was it backed by any evidence.

The Supreme Court said it also considered whether the appellant
complied with the rules of the Court of Appeal on the issue of filing
of notice of appeal.

"Where a defendant is not aware of a pending litigation against the
defendant, proceeding held in respect of the issue is nullity.

"In this instant case, there is evidence that the 2nd-36 respondents
were not served with appeal notices and there is no evidence from the
Court of Appeal showing that an order of substituted service was made.

"Failure to serve notice of appeal on the respondents offends the
provision of Order 2 Rule 3 of the Court of Appeal and non filing of
notice of appeal is a flagrant abuse of Order 2 Rule 3, and thereby
renders it incompetent", the Supreme Court held.

The court further held that the appellant instead of serving the
proper parties, dumped the notice of appeal at the office of the APC
on July 28, 2015, "whereas there was no order for substituted
service".

"Let me categorically state here that the court is not a slave to
rules; non compliance with rules guiding the service of notice of
appeal and other processes is incurably defective. I agree that not
every non compliance with the rules vitiates a proceeding, but service
of processes is important and fundamental; failure to do this offends
Section 36 (1) of the Constitution" Justice Okoro said.

"Failure to serve the respondents is a breach of fair hearing;
confusion of the appellant arises from their erroneous belief that3-36
respondents are not part of the case. Appellant made a serious blunder
by effecting service of its originating summon with levity.
"Appeal was not commenced by due process of the law; failure to put
the names and addresses of respondents on the notice of appeal was
fatal to the case. Law is trite that notice of appeal is its
foundation. There is no merit in this appeal. 

"Judgment of the Court of Appeal Owerri is accordingly upheld" Justice
Okoro added.

Women Protest Cancellation Of Wike’s Election

SCORES of market women in Rivers State took to the streets on Thursday
to protest the nullification of the election of the State Governor,
Chief Nyesom Wike.

The women, who were from various markets in Port Harcourt and other
parts of the state, had marched from Aba Road to Government House in
the state capital to express their dissatisfaction over the annulment
of the April 11, 2015 governorship election.

Carrying placards with various inscriptions that captured their
feelings about the recent political development in the state, the
women said they needed peace in the state with Wike as the governor.

Some of the inscriptions on the placards read, 'Wike is the People's
choice', Ogu/Bolo is behind Wike', 'Cancellation of Wike's election is
not justice', and 'On Wike, we stand'.

The Organising Secretary of Rivers Market Women Association, Mrs.
Evelyn Nweke, explained that majority of the people in the state voted
for Wike, adding that the market women were not happy with the ruling
of the State Election Petitions Tribunal.

Nweke, who spoke shortly after the protest, stated that while
elections in All Progressives Congress-controlled states were upheld
by the court, elections in states where the Peoples Democratic Party
held sway were cancelled.

"Despite the ruling, we are happy that Governor Wike is still on seat
in Government House. We will not insult the judiciary. Every judge has
the right to give whatever decision he likes, but God has the final
say.

"We are aware of how the Wike's administration paid pensioners their
pensions after they were owed for months by the immediate past
administration. We want peace in Rivers; we are happy with our
governor and it is unacceptable to say that elections did not hold in
Rivers," she added.

The protesting market women, who later took their protested to the
state PDP secretariat located along Port Harcourt-Aba expressway, were
later addressed by party officials.

In his response, the State PDP Deputy Chairman, Mr. Monwan Etete,
thanked the market women for making their protest a peaceful one,
adding that the party was also worried over the ruling of the
tribunal.

Etete expressed optimism that the Appeal Court would look into the
position of the party and upturn the ruling by the lower court.

He said, "It is only mothers and good women that can demonstrate
peacefully the way you did today. We as a party are not also happy
about the judgement of the court, but we believe that with our appeal,
the decision of the court would be upturned in our favour."

Etete, however, promised the women that the state PDP would take their
grievance to the state governor.

How We Use ‘Juju’ To Rob Traders In Lagos Markets — Robbery Suspects (Pictured)

It was payback time for a two-man robbery gang which specialised in
raiding markets in Lagos and dispossessing traders of their wares and
cash, following its arrest by the Police in Lagos.



The suspects; Saidi Olalekan (32) and Joshua Akinsola (20), who
claimed to be a Nigerien, were arrested at Oshodi market during a
foiled attempt to rob a textile shop owner of some lace materials and
cash worth N2.5 million
Recovered from them were stolen lace materials worth N300,000 and cash
of N2 million.

During an interview with Vanguard, the suspects revealed that
information on their victims were usually given by their sales
representatives. They also confessed that they use charms to hypnotise
their victims, a means they said made their operation easy.

But nemesis caught up with them after one of their victims who
apparently was not affected by the charms raised the alarm which led
to the arrest of Akinsola, the supposed Nigerien.
32-year-old Olalekan, an indigene of Ogun state who recently completed
a two-year-jail term, said: "We do not use any gun or dangerous weapon
during operation. What we used was a charm called atare and ohun. This
charm was prepared by a herbalists in Apapa. That is what most 419
people use.

"Any time we were going for operation, we would put the charm in our
mouth and another in the pocket. We would thereafter, enter any of the
shops and order anyone there to bring the proceed for the day. We
would also command them to bring as much yards of material they could
lay their hands on. They will obey without complaining. Also, no
customer will come to that shop as long as we remained there. After
the raid, we would quietly leave the shop. Our victims usually regain
consciousness several hours later.

"At the end of each operation, we would take the stolen materials far
away from where we stole them and sell them at give away prices. For
instance, if we steal material from Idumota , we will take it to Agege
or even Sango in Ogun state to sell and share whatever was realised
equally."

My victim had a counter-charm
On his part, his alleged partner in crime, Joshua Akinsola, disclosed
that they usually get information either from sales representatives of
their victims, their managers or relatives.

Oshodi operation and counter-charm
On the Oshodi botched operation, he said his victim apparently had an
antidote to charms that gave them away.
He said: "While Olalekan was in one of the shops, I was in another. He
succeeded in carrying some wares and N2 million cash from his victim.
But I realised that after making some incantations with the charms in
my mouth and pocket, my victims did not succumb, and had I left the
shop with some lace materials than they raised the alarm which
attracted other traders at Oshodi.

"Before I knew it, some policemen arrived the scene and whisked me
away. I led them to my colleague where the stolen N2 million was
recovered. I am from Niger Republic but I live at Ogolo, around Benin
Republic."
The suspects according to the Lagos State Commissioner of Police, Mr
Fatai Owoseni, will be charged to court soon.

In order to beat the deadline set by President Muhammedu Buhari to end
insurgency in the country, the Nigeria Army has released images of
some of the most wanted suspects of the sect (Boko Haram).



The images of the wanted sect members were today, boldly shown on a
banner and were displayed by the Chief of Army Staff, Lt – Gen. Tukur
Buratai among other officers.

Inscription on the banner however urged Nigerians to report to the
Army if any of the persons on the banner is seen anywhere in public.

Heart Attack, Stroke, Now Nigeria’s No.1 Killer Diseases – Cardiologist

A Professor of Medicine at Babcock University, Ogun State, Dr. Kamar
Adeleke, has raised alarm over the rising incidence of heart attack,
stroke, hypertension and other cardiovascular disorders in the
country.

Adeleke, who spoke during the inauguration of Tristate Heart and
Vascular Centre at the institution's Division of Cardiovascular
Diseases, lamented that cardiovascular disorders have overtaken
infectious diseases such as malaria as the nation's leading
killer-diseases.

Addressing a world press conference, the cardiologist said the No 1
killer in Nigeria is heart disease, followed by stroke.

"To confirm to you that many Nigerians suffer heart-related crises, we
were in UCH, Ibadan sometime ago on medical mission and found out that
at least six of the eight patients picked randomly and tested, were
confirmed to be suffering from chronic heart problems.

"Such development led to this partnership to care for many Nigerians
suffering from cardiovascular diseases," he said.

Further, Adeleke explained that while the silent killer diseases have
been effectively managed medically by America, leading to an average
life expectancy of 80 years, in Nigeria, it is 51 to 52 years because
there is little or no attention to heart-care.

"Know your blood pressure, know your cholesterol and sugar level to
avoid sudden cardiac arrest," the expert said.

Pointing out the importance of exercise to longevity, he disclosed
that regular exercises in three days will increase your years to 2.8
years.

He said no fewer than 40 patients with heart diseases have been
operated on at Babcock University.

"Majority paid little or no money, because some organisations like
First Bank have been sponsoring it.

"We have 15 expatriates that have signed a 2-year contract with
Babcock University. Part of the agreement is for them to reproduce
themselves within these two years. Once we have started, we hope to
sustain it, because programmes are not sustained in Nigeria due to
lack of competence."

He noted that while heart surgery in parts of the world cost $75,000,
in Babcock it cost just $15,000.

On his part, the Vice Chancellor, Babcock University, Professor Kayode
Makinde vowed that no person with heart disease would die due to lack
of funds.

"We will locate organisations or somebody in Nigeria who can assist so
that nobody will die due to lack of fund.

"We will not manage anything in the course of doing our work for
humanity, though equipment for this operations are costly. Development
brought close to the people, is the development made relevant," he
said.

Boko Haram Suspects Taken Away From Ekwulobia Prison – Report

The 47 suspected members of Boko Haram who were transferred to the
medium security prison located in Ekwulobia in Aguata local government
area of Anambra State in June this year have been taken away from the
prison to the relief of the people of the town.

According to Vanguard, the prisoners were removed on Tuesday night to
an unknown destination amidst tight security.

Citing a very reliable source, the confirmed that the detainees have
left the state to the delight of the people residing near the
Ekwulobia Prisons.

There were about 134 inmates at the Ekwulobia prison before the 47
Boko Haram prisoners were brought in the dead of the night of Sunday,
June 28, 2015 amidst tight security.

This was followed by protests by traders in all the major towns in
Anambra State before calm eventually returned.

Vanguard reports that a visit to Ekwulobia Prison yesterday showed
that the heavy security presence that was mounted shortly after the
suspects were brought to the town has relaxed, as the snipers that
usually sat atop a structure at the prison were not seen on their duty
post.

The gate of the prison was also open, unlike what the situation had
been for the past three months.

People living around the prison, however, said they did not know that
the Boko Haram prisoners had been removed from Ekwulobia, although
they said they would be happy if it was true.

Sacked Priest Accuses Vatican Of Making Life ‘Hell’ For Gays

A high-ranking Polish Catholic priest who was sacked after he came out
as gay has accused the Vatican of making the lives of homosexuals "a
hell", in a letter sent to the pope seen Wednesday by AFP.

Krzysztof Charamsa thanked Pope Francis for his positive words and
gestures but criticised what he called the Vatican's hypocrisy in
banning gay priests even though he said the clergy was "full" of
homosexuals.

"Have a minimum of mercy. At least leave us alone, allow civil
societies to make our lives more human, while you, with your church,
have managed to make the lives of us homosexuals a hell," he wrote in
the letter dated October 3.

Charamsa sparked outrage at the Vatican that day by publicly declaring
his homosexuality — and presenting his Spanish boyfriend Eduardo
Planas — on the eve of a bishops' synod which touched on the divisive
issue of the Church's relationship to gay believers.

A Polish bishop last week defrocked the 43-year-old priest, who now
lives in Barcelona with his partner.
Charamsa had held a senior position working for the Vatican office for
protecting Catholic dogma, the Congregation for the Doctrine of the
Faith.

He wrote that after a "long and tormented period of discernment and
prayer", he had taken the decision to "publicly reject the violence of
the Church towards homosexual, lesbian, bisexual, transsexual and
intersexual people".

"Today I have put myself on the side of the fantastic homosexual
people, who have during centuries been humiliated by a fanatical
church," he added.

"All gay cardinals, bishops and priests should have the courage to
leave this insensible, unjust and violent church."

While Charamsa can no longer perform priestly duties, he has not been
excommunicated, a move that would entirely banish him from the
Catholic church.

The pontiff met a gay former student of his during his recent visit to
the United States and has previously said that gay people should not
be marginalised in society.

But a report adopted by Catholic bishops at the end of their
three-week synod on Saturday includes only one brief article on the
Church's approach to gay believers, framing the question in terms of
how priests can help support families who have "persons with
homosexual tendencies" in their midst.

The report strongly reiterates the Church's opposition to gay
marriage, saying: "There are absolutely no grounds for considering
homosexual unions to be similar or even remotely analogous to God's
plan for marriage and the family."

Now That Nigeria Is Polio-Free

If there is one piece of news making Nigerians happy, it is that from
the World Health Organisation (WHO) that the country has been removed
from the list of polio-endemic nations. The announcement is coming
after the historic achievement in interrupting the transmission of
wild poliovirus for a period of 15 months. With this development, only
two countries –Afghanistan and Pakistan now remain polio-endemic.
Before now, Nigeria accounted for over half of all polio cases
worldwide.

Therefore, the remarkable change in the narrative represents a great
positive leap forward.

According to WHO, the eradication of poliovirus is the result of a
concerted effort by all levels of government, civil society, religious
leaders and tens of thousands of dedicated health workers?

Even though removal from the list is not a definitive indication of
freedom from polio, there is cause for optimism that the two-year wait
to qualify for full polio-free certification will perfect Nigeria's
polio-free status. Much as welcome the news, Nigeria should not rest
on her oars, thinking that the last has been heard of this
debilitating disease. Rather, the country should see the effort to
keep the virus at bay as its responsibility and ensure that whether
financial aid comes from abroad or not, the feat achieved would not be
lost to bureaucracy and the perennial excuse of lack of funds that
form the pretext for not sustaining a set objective.

That is why we welcome President Muhammadu Buhari's pledge to keep up
the momentum as well as maintain and improve on the country's
surveillance system as well as raise the childhood population immunity
against the poliovirus. In addition, we urge institutions involved in
the fight against polio to continue to do everything they did right,
which helped in the achievement of the success story we are now
celebrating. In the light of this, they should continuously think out
ways to deepen the success accomplished, so that polio will forever
remain outdated in Nigeria.

Only three years ago, Nigeria looked like the last place that would
eliminate polio, a highly infectious and potentially fatal disease
that invades the nervous system and paralysed 1,000 children a day as
late as the 1980s.

Measured against other equally difficult health challenges, such as
HIV/AIDS and Malaria, the polio fight is certainly a great
achievement. Now that the world is within a 'touching distance' of
eradicating polio, Nigeria and the whole world can help make the last
round of the battle against polio less difficult by sensitising the
public, especially rural communities on the deadly danger of the
virus. There should be sensitisation programme on community hygiene
and other sanitary issues.

Against this backdrop, the country's political and health authorities
have their work cut out for them. It is necessary to provide
unrestricted running water to the people, and to ensure hygienic human
waste disposal, among other important actions. We therefore appeal to
governments at all levels, traditional and religious leaders, as well
as the private sector to redouble their efforts to keep this
paralysing and deadly scourge at bay.

road, on their way to Lagos.

Teenager Killed Over Girl In Nnewi

Residents of Okpuno Otolo in Nnewi North Local Government Area of
Anambra State were at the weekend thrown into confusion when an
eighteen-year-old boy, a student, whose name was given as Chinaza was
allegedly stabbed to death in a fight over a girl.

The source said the deceased had met at a joint with the suspect whose
name was not disclosed at the time of filing this report where
argument ensued regarding the suspect's alleged meddling into a
discussion involving the victim's relation, a girl.

The suspect was said to have been cautioned by the victim to steer
clear of the discussion, according to our source, and the caution led
to an argument that led to a fight.

Witness said the two were separated in the fight but later resumed
after a while when the suspect grabbed a bottle and stabbed the victim
leading to his death at a hospital where he was rushed to.

The suspect was said to have made for an escape before he was arrested
by the vigilance group who handed him over to the police.

Contacted, the Police Public Relations Officer, Anambra State Police
Command, Awka, Mr Ali Okechukwu said the report had not been recorded
in his office.

Nigeria Fines MTN $5bn For Failing To Disconnect Unregistered Subscribers

Nigeria's Communications Commission, the country's telecommunications
regulator, has issued mobile phone firm MTN Nigeria, with a $5bn
(£3.5bn) fine for failing to disconnect subscribers with unregistered
Sim cards bought before January 2012.

From that date anyone buying a SIM card in Nigeria has had to register
it under their name by law.

Phone companies were told to register their existing customers' SIM
cards, which MTN Nigeria – the biggest telecommunications firm in
Nigeria – has failed to do.

The fine is the largest in the history of telecom infringements in
Nigeria and may redefine the relationships between telecommunications
operators and the regulator.

Nigerians continue to complain about poor services from mobile network
operators and blame the regulators for not doing enough to solve the
problem.

A senior executive at MTN Nigeria tells me that the company will issue
a statement on the fine later today.

FIFA Presidency: No Nigerian Nomination Submitted As Deadline Ends

All the talk of a Nigerian Presidency of the Federation of
International Football Associations (FIFA) yesterday ended like hot
air blown into a balloon, with the deadline for
submission of nomination expired last night, with neither Segun
Odegbami nor Orji Uzor Kalu submitting their forms, as at press time.

The two Nigerian gladiators, the former, a 1980 Nations Cup winner and
the latter, a two-time Governor of Abia State, had in the last couple
of months been involved a two-way battle to get the nod of the Amaju
Pinnick-led Executive Committee of the Nigeria Football Federation to
run for the biggest office in world football.

Since it became clear that Sepp Blatter's successor would emerge at an
extraordinary congress next February 26, the race for the plum job has
assumed an intense and frenetic pace, with many self-professed
football buffs entering the fray, with little or no understanding of
the dynamics involved to aspire for the position.

While the NFF had earlier hesitated to back Odegbami and Kalu, it
later buckled, with reports that it endorsed Odegbami, who we however
gathered as at press time, was yet to file his nomination with FIFA.

As at the filing of this report, only seven candidates had submitted
their nominations, with UEFA supporting a 'holding' application from
its general secretary, Gianni Infantino.

Sports Vanguard reports authoritatively that Odegbami and Kalu might
have fallen off the way because of the qualification demands, which
comprise a minimum of five written endorsements from national football
federations plus a declaration of a role in the game in two of the
past five years.

Besides the submission of their nomination forms, all aspiring
contenders will have their submissions put through an integrity test
by the Ethics Committee before being confirmed, formally, as
candidates to stand to succeed Blatter on February 26.

For clarification purpose, the seven hopefuls vying for Blatter's
position include Prince Ali bin Al Hussein of Jordan, Musa Bility, who
is the President of the Liberian Football Federation, Jerome
Champagne, Gianni Infantino, who is the General Secretary of UEFA,
David Nakhid, a one time Trinidad international, Michel Platini, who
is the suspended President of UEFA and Tokyo Sexwale, a South African
businessman and head of FIFA's Palestine-Israel Monitoring Commission.

However confusion surrounded a planned candidacy from Asian
Confederation head, Sheikh Salman bin Ebrahim Al Khalifa of Bahrain,
with suggestions that he might have been advised to step back after
last-minute negotiations because of his alleged role in the detention
and torture of footballers and other athletes in a Bahrain crackdown
in 2011. But Sheikh Salman has always denied the claims.

The Nigerian no-show is bound to be a bizzare end to a late-minute
foray into the global politics of world football by Odegbami and Kalu,
who had hitherto been advised to withdraw their intentions because of
their perceived lightweight status.

They were expected to have toed the way of the likes of Zico, David
Ginola, Ramon Vega who all withdrew from the race after earlier
declaring their intentions to succeed Blatter.

Interestingly, Zico, who like Odegbami, is a Brazilian legend, on
seeking the support of his own Brazilian confederation, was told it
would back him only if he could first find four other countries
willing to nominate him, which sadly he was unable to find.

NCC Withdraws ‘Data Floor Price’ For Telecoms Operators

The Nigerian Communications Commission (NCC) on Monday said it has
withdrawn the "data floor price'' for operators in the
telecommunications industry.

"Floor price'' is a government or group-imposed price control or the
limit a price can be charged for a product to check unhealthy rivalry
among players.

In a statement in Lagos, the commission said that the withdrawal was
in a bid to ensure sustainability, growth and development of the data
service market segment.

"However, the commission will restore the floor price if any
distortion is observed within the market segment,'' it said.

NAN reports that with the withdrawal of the price, telecommunications
industry now has the permission of NCC to charge subscribers lower
than the set lowest industry prices.

The regulatory body had in May 2013 imposed a price floor on
telecommunications operators in the country as a means of controlling
anti-competitive behaviours by operators considered to have attained
the dominant status in the industry.
Such anti-competitive behaviours include charging calls within their
networks much lower than what they charged for calls terminating on
other networks.
With this, the operators might just be setting up calling clubs – a
practice where subscribers just call those within the network of their
own service providers.

Rivers Assembly Speaker, 20 Other Lawmakers Sacked By Tribunal

The Rivers State Election Petitions Tribunal sitting in Abuja
yesterday nullified the victory of 21 out of the 32 members of the
state House of Assembly.

Top on the list of the sacked legislators is the Speaker of the State
House of Assembly, Hon Owaji Ibani from Andoni constituency.

The nullification of the Rivers lawmakers came barely two days after
another tribunal nullified the election that brought Governor Nyesom
Wike into power as the state governor.

The tribunal cited cases of irregularities and violence among other
electoral malpractices which warranted the nullification of the
lawmakers' election.

Other constituencies where PDP candidates' elections were nullified
are Gokana, Eleme, Obio/Akpor I and II, Eleme, Etche II, Opobo/Nkoro,
Akukutoru I and II, Asari Toru – and II, Bonny, Tai, Onelga I, Degema,
Khana Iand II, Port Harcourt II and Ikwerre.

The tribunal further directed that fresh elections should be conducted
to fill the vacant seats.

The tribunal ordered fresh elections to be conducted in the 20 constituencies.

But the elections of the PDP candidates were upheld by the tribunal in
11 constituencies which are Oyigbo, Etche I, Omuma, Ogu-Bolo, Port
Harcourt I and III, ONELGa II, Abua/Odua, Ahoada West, Ahoada East II
and Emuoha.

Earlier in the preliminary stage, the tribunal had upheld the election
of PDP candidate in Okrika constituency.

It is yet uncertain what will happen next since the remaining 11
legislators would not be able form a quorum for the state's
legislative businesses.

But indications have emerged that the affected legislators will appeal
the judgement.

Okorocha Shuts Imo General Hospitals, Doctors, Patients Affected

The Imo State Government, on Sunday, locked up all its General
Hospitals in state with the aid of suspected thugs and chased all the
workers out thereby denying people access to healthcare services.

The affected General Hospitals were in Aboh Mbaise, Umuguma,
Awo-Ommama, Arondizuogu, Ngor-Okpala, Ogwa.

Governor Rochas Okorocha had earlier announced the concession of
health institutions, including primary health centres in the rural
areas, as well as over 17 parastatals in the state.

Daily Times gathered that the state security outfit, the Imo Security
Network, invaded different hospitals and forced every staff and
patients out the hospitals.

When Daily Times visited Umuguma Specialist Hospital, in Owerri West
Local Government Area, on Monday, fracas broke out between the
leadership of the organised labour and operatives of Imo Security
Network, when the labour union officials tried to reopen the hospital.

They later over-powered the men of Imo Security Network, led by former
commissioner for Public Utilities, Dr. Ifeanyi Nwachukwu.

Confirming the incident, the State Chairman of Nigeria Labour Congress
(NLC), Mr. Austin Chilakpu, expressed shocked that the state
government could embark on such a move when the Federal Ministry of
Labour through Industrial Arbitration Panel had intervened on the
concession.

He said that the state government was directed to discuss the fate of
workers with the organsed labour and report back for further
discussion.

While Okorocha has embarked on building 27 general hospitals, the
existing state owned hospitals were in the state of despair, while the
state government had, for a long time stopped funding them.

Reacting, the Chairman Task Force on Health and former Commissioner
for Health, Dr. Edward Ihejirika, admitted that the state government
had closed down the hospitals to carry out renovations in them ahead
of the takeover by the concessioneers.

Chairman of the Hospital Workers Welfare Association, Mrs. Ngozi
Onyeaka, said the lock out was as a result of the workers refusing the
concesssioning of the hospitals.

It was gathered that the workers were being owed 12 months' salary,
four months in arrears from 2014 and eight months in 2015.

Imo State Governor Names Government Building After Daughter

Imo State Governor Rochas Okorocha, has named a government building
after his first daughter, Uloma Nwosu (nee Okorocha).

Uloma is married to Uche Nwosu, a former Commissioner in Governor
Okorocha's cabinet. Uloma Nwosu is the Director General of her
father's foundation, Rochas Okorocha Foundation while her husband who
was the Honorable Commissioner for Land Survey and Urban Planning is
now the state Chief of Staff.

Sepp Blatter Endorses Orji Kalu For FIFA President

FIFA president, Sepp Blatter has endorsed former Abia State Governor,
Dr Orji Uzor Kalu's FIFA Presidency ambition.
Speaking in Zurich, Blatter said "the position of the FIFA president
is too important to be left to just anybody. I have heard of some
candidates who want to take over from me. But I find the Businessman
from Nigeria Kalu very qualified and interesting because he is not
only a businessman, but a politician with lots of contacts and
corporate experience. He can bring his great experiences to bear in
the running of world football."

He is passionate about the game. I remember how he sponsored one of
Nigerian clubs to win the CAF championship twice. He is a man that can
take world football to the next level", Blatter told the Swiss Radio
monitored on Sunday.

Blatter said though Kalu had not formally declared his interest, it
was in the best interest of Africa to nominate him because of his deep
passion for the game. "If Africa hopes to win the support of other
federations, then they must queue behind the Nigerian business man.

Ile-Ife Gets A New Ooni: Adeyeye Ogunwusi

A new king has been unveiled for the Yoruba town of Ile-Ife, in Osun State.

He is Prince Adeyeye Enitan Ogunwusi of the Giesi ruling house and a
holder of Higher National Diploma in Accountancy from the Polytechnic
Ibadan. He is 40 years old.

According to a 24 October 2015 statement, entitled "Appointment of a
New Ooni," , "This follows the completion of the due process and the
communication of their (Kingmakers') choice to the government."

Ogunwusi will sit on the throne of Oduduwa, left by Oba Okunade
Sijuade, who died on July 28 2015 in a London hospital.

The statement was signed by secretary to the state government, Alhaji
Moshood Adeoti.

The announcement of a new Ooni followed Friday's judgment by an Osun
State High court dismissing a suit challenging the Ooni of Ife 1980
Chieftaincy Declaration.

Sooko Adegoke and Prince Marcus Adebola Akimoyero on behalf of
Lafogido Ruling House of Ile-Ife, had sued Governor Rauf Aregbesola,
the Obalufe of Ile-Ife, the late Oba Solomon Omisakin and Lowa of Ife,
Chief Joseph Ijaodola over the decision to allow only the Giesi Ruling
House to present a candidate for the stool.

The plaintiffs asked the court to set aside the 1980 Ife Chieftaincy
Declaration which they said was "lopsided, unjust, unconstitutional
and unfair."

Abia Tribunal Annuls Election, Bars APGA From Re-run

THE National and State Assemblies Election Petitions Tribunal sitting
in Umuahia has barred the opposition All Progressives Grand Alliance,
APGA, from participating in a fresh election it ordered in Aba North
State Constituency.

The tribunal has nullified the election of Mr. Emeka Nnamani of All
Progressives Grand Alliance, APGA, representing Aba North State
Constituency on the ground that he was ab initio not qualified to
contest the election held on April 11, 2015.

Delivering judgment in the petition filed by Dr. Blessing Nwagba of
PDP challenging the election of Nnamani, the tribunal nullified his
election and ordered a fresh election in the constituency but said
that APGA would not participate in the fresh election.

According to the chairman of the tribunal, Justice Sabiu Yahuza, "the
petitioner, Dr. Nwagba proved the allegation of non-qualification
leveled against the respondent as his name was not in the register of
his Eziama Ward of his party, APGA, and ought not to have participated
in the said election."

The panel however exempted APGA from participating in the re-run of
the election, saying that it would be between the petitioner's party,
PDP, and the other candidates from the other parties that participated
in the April election.

On the allegation that Nnamani forged the certificate of University of
Port Harcourt, the tribunal directed the police to investigate the
matter and prosecute the respondent if found culpable.

It would be recalled that during the trial, the tribunal admitted in
evidence a letter from the Registrar of the University of Port
Harcourt disowning Nnamani as a graduate of the University.

Concentrate On Boko Haram Now, Not MASSOB -- Monarch Tells Buhari

President Muhammadu Buhari has been urged to stop the clamp down on
members of the Movement for the Actualization of the Sovereign State
of Biafra (MASSOB), but should concentrate on how to end Boko Haram
insurgence in the country.

The traditional ruler of Emede Ibeku Autonomous Community in Umuahia
North Local Government Area, Eze Henry Ezekwem, made the call in
Umuahia, and described the clamp down on MASSOB as a misplacement of
priority by the federal government.

Ezekwem was of the view that the government should concentrate on how
to stop the killings, destruction of life and properties of innocent
and law-abiding citizens of the country, which is perpetrated by the
armed Boko Haram group, instead of beaming its search light on the
MASSOB group, which, he said, were agitating peacefully for a cause.

While pointing out that the country was running a democratic system of
government, where citizens had the right to express their opinions,
the traditional ruler noted that unlike the deadly Boko Haram group,
the MASSOB does not pose any threat to human lives as they do not
carry arms to agitate their cause.

"In the North there is Arewa, in the South there is Oduduwa, in the
Niger Delta, we have the militants while in the South East, there is
MASSOB, all crusading for a cause. MASSOB does not pose any threat to
human lives.

"The Federal Government should stop the killing of members of this
group as they are demonstrating peacefully without weapons and
concentrate on ending Boko Haram in Nigeria. If God says he will not
approve Biafra, nobody will question Him".

Meanwhile MASSOB has declared that no amount of intimidation, arrests
and killings would deter NdiIgbo from aspiring for their separate
homeland in the face marginalisation and a concerted effort to
decimate the Igbo people.

Spokesman of the group, Uchenna Madu, said the recent memo dispatched
from the office of the Inspector General of Police (IGP) to all
commissioners of Police in the south-east to the effect that members
of MASSOB be apprehended wherever they were found would not hold
water, maintaining that all efforts to suppress the group would amount
to a waste of time and resources of the government.

Full Text Of Governor Wike’s State Broadcast After Tribunal Ruling

My dear people of Rivers State

It is with a profound sense of concern and responsibility that I
address you over the judgment of the Rivers State Governorship
Election Petition Tribunal delivered on Saturday, October 24, 2015,
purportedly nullifying my election and return as the duly and lawfully
elected Governor of our State.

2. We all know that on April 11, 2015, Rivers people in their millions
joined the rest of the country and enthusiastically participated in
electing their Governor and members of the State House of Assembly.

3. Apart from the reported malfunctioning of the card readers supplied
by the Independent National Electoral Commission (INEC), which placed
no advantage on any of the contestants, the election took place
throughout the State and was adjudged both by local and international
observers to be largely peaceful, transparent, free, fair and
credible.

4. Following the success of the election, I was returned as duly and
lawfully elected by the INEC, having satisfied all the necessary legal
requirements.

5. However, following the petitions by my friend, the APC
gubernatorial candidate and his party, and despite the woeful failure
of the Petitioners to discharge the burden of proof with respect to
their contradictory, wild and false allegations against the conduct of
the election, the State Governorship Election Petition Tribunal
nullified my election on the basis of INEC's alleged infraction of its
administrative guidelines on the use of card readers.

6. It is common knowledge that INEC's card readers malfunctioned
throughout the country in the 2015 general elections. It is also
common knowledge that wherever the card reader malfunctioned, manual
accreditation, which is the only process, recognized by the current
Electoral Act, was used to accredit voters all over the country.

7. So far I am not aware of any State where the election was postponed
as a result of failure of card readers. Furthermore, the Court of
Appeal in Agbaje v Ambode clearly stated that the partial or non-use
of card readers is not the basis for the cancellation of an election.

8. Yet, against all legal odds and the grains of logic, the Tribunal
in its wisdom decided to accord undue legal weight to the straw of
statements around the use or non-use of card readers to support its
decision in the face of a hopelessly bad case of the Petitioners.

9. As we all know, our judicial system is built on the doctrine of
hierarchy of courts in which lower courts are bound by the decisions
of courts higher in hierarchy on the same or similar issues. It is
therefore strange for the Rivers State Governorship Election Tribunal
to arrive at a decision that negates subsisting judgments of the Court
of Appeal or the Supreme Court.

10. Being an implacable believer in the majesty of our judicial system
as the last hope of the common man, I have implicit confidence in the
ability of the appellate courts to correct the mistakes of the
Tribunal and right the wrong that has been done to our collective
psyche and aspiration.

11. Accordingly, I have since instructed my team of lawyers to
immediately commence the appeal process and have the decision of the
Rivers State Governorship Election Petition Tribunal upturned for
good.

12. At this point, I appeal to all our supporters across the state and
beyond to remain calm and go about their legitimate duties in a
peaceful manner. There is no cause for alarm.

13. By virtue of the Constitution and the Electoral Act, I am still
your Governor and will remain your Governor until the exhaustive
conclusion of the appeal process at the Supreme Court.

14. Therefore, be assured that your mandate, which you freely gave to
the Peoples Democratic Party and my humble self, is intact, safe and
secure. God will not allow your mandate to come to naught.

15. I wish to thank the people of Rivers State for the unwavering
support I have enjoyed from you since the beginning of the struggle to
this moment. I am highly humbled with the show of solidarity from all
and sundry and in particular, the confidence in our ability to move
the State forward, and the overwhelming satisfaction with what we are
already doing as our government to reposition the State.

16. I wish to further assure you that my team and I will not be
distracted by this minor irritation. We shall remain focused on our
vision and continue to deliver on our fundamental promises on
improving security, massive development of infrastructure and
socio-economic empowerment in Rivers State.

17. Finally, be assured that by the special grace of God, we shall
ultimately prevail over our adversaries, retain our mandate and return
the glory to God Almighty our Maker and Refuge.
